WALKER ART COLLECTION · INSTITUTIONAL GOVERNANCE

Terms of Use

Conditions governing access to the Collection’s website, Digital Museum, publications, and institutional resources.

SECTION 01

Acceptance and Scope

These Terms of Use govern access to and use of the Walker Art Collection website, Digital Museum, online artwork studies, publications, audio recordings, and related public digital resources. By using these services, visitors agree to comply with applicable law and these Terms. Additional conditions may apply to restricted institutional or research access.

SECTION 02

Ownership and Intellectual Property

Unless otherwise expressly indicated, artwork images, written interpretations, exhibition materials, recordings, design elements, and other original Collection content are protected by applicable intellectual property laws. Access to content does not transfer ownership or grant permission to reproduce, redistribute, publish, license, or commercially exploit it. Any third-party materials remain subject to their respective rights.

SECTION 03

Permitted Use

Visitors may browse public pages and use materials for ordinary personal viewing and reference, subject to applicable law and any clearly stated restrictions. Limited quotation or other uses permitted by law are not prohibited by these Terms. Any additional reproduction, display, adaptation, or distribution may require prior written authorization.

SECTION 04

Prohibited Conduct

Visitors must not attempt unauthorized access; interfere with website security or availability; misrepresent identity or institutional affiliation; circumvent access restrictions; or systematically harvest protected images, metadata, recordings, or other materials in violation of applicable law or access conditions. Automated access that impairs services or bypasses controls is prohibited.

SECTION 05

Artwork Images and Reproduction

Images and documentation presented through the Digital Museum are made available for viewing and interpretation, not as an open license for reuse. Requests for publication, exhibition, licensing, or reproduction should follow the Collection's Image Rights & Reproduction guidance. Applicable statutory exceptions and limitations remain unaffected.

SECTION 06

Institutional and Research Access

Institutional or research access may require an application, approval, and account credentials. Approval is discretionary and may be limited, modified, or withdrawn in accordance with applicable access conditions. Authorized users are responsible for safeguarding credentials and respecting any restrictions on nonpublic materials.

SECTION 07

Journal and Publications

The Collection’s essays, Journal publications, catalogs, interpretive texts, and audio materials are provided for education, research, and cultural engagement. Views expressed in interpretive materials reflect their stated authorship and context. Publications made available through related Collection platforms are subject to applicable notices and access conditions.

SECTION 08

Accuracy and Availability

The Collection seeks to present accurate information, but artwork metadata, descriptions, attribution details, publication status, and digital features may be revised as documentation develops. Website services may be changed, suspended, or unavailable without notice. No guarantee of uninterrupted access is made.

SECTION 09

External Services and Links

The website may link to third-party services or resources. The Collection does not control their content, availability, privacy practices, or terms, and a link does not necessarily imply endorsement.

SECTION 10

Privacy

Handling of personal information is addressed in the Collection's Privacy Policy. Additional privacy notices may apply when visitors use external platforms or restricted services.

SECTION 11

Disclaimers

To the extent permitted by applicable law, public website materials and digital services are provided on an as-available basis without warranties of uninterrupted operation or suitability for a particular purpose. Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.

SECTION 12

Limitation of Liability

To the extent permitted by applicable law, the Collection and its responsible operator are not liable for indirect or consequential losses arising from use of public website resources. This provision does not limit liability where doing so would be unlawful, including any non-excludable statutory rights.

SECTION 13

Changes and Contact

The Collection may revise these Terms to reflect changes in its programs, services, or applicable requirements. Updated Terms will be published on this page. Questions or permissions inquiries may be submitted through the Collection’s Contact page.
